Selangor water restructuring agreement: Charles, Rafizi raise critical concerns

MPs Charles Santiago and Rafizi Ramli have raised a number of critical questions over the Selangor water restructuring agreement with the federal government. The lack of transparency is worrying.

More importantly, does Khalid Ibrahim have the mandate to sign on behalf of the Selangor government at this critical juncture when he does not appear to command the confidence of the Selangor State Assembly? Charles Santiago pursues this angle here.

Rafizi Ramli, for his part, raises more questions:

Rakyat perlu tahu kandungan perjanjian penstrukturan air

Saya sedia maklum bahawa Kerajaan Selangor telah menandatangani Perjanjian Utama (Master Agreement) penstrukturan air di antara agensi Kerajaan Persekutuan dan tiga pemegang konsesi iaitu Puncak Niaga, Syabas dan Abass. Perjanjian itu tidak melibatkan satu lagi pemegang konsesi iaitu Splash.

Sejak dari awal, Tan Sri Khalid Ibrahim tidak memaklumkan sebarang isi kandungan rundingan atau perjanjian yang dirundingkan kepada saya walaupun saya diberi mandat oleh Majlis Presiden Pakatan Rakyat untuk meneliti isi kandungan rundingan atau perjanjian, selain dari Saudara Tony Pua (mewakili DAP) dan Saudara Dzulkifly Ahmad (mewakili PAS).

Malah, arahan Majlis Presiden Pakatan Rakyat yang turut sama dihadiri oleh Dato’ Seri Anwar Ibrahim, Dato’ Seri Abdul Hadi Awang dan Saudara Lim Kit Siang (pada mesyuaray 6 Mac 2014) secara jelas memutuskan bahawa Tan Sri Khalid Ibrahim tidak boleh memeterai sebarang perjanjian tanpa persetujuan Pakatan Rakyat yang diwakili oleh kami (saya, Saudara Tony Pua dan Saudara Dzulkifly Ahmad) bertiga.

Arahan itu telah diengkari berkali-kali. Oleh sebab itu, perjanjian yang dimeterai pada hari ini dibuat tanpa sebarang maklumat yang disampaikan kepada saya atau pun menerima sebarang maklumbalas dari wakil-wakil Pakatan Rakyat.

Saya menasihati Tan Sri Khalid Ibrahim supaya dengan segera mendedahkan perjanjian ini kepada rakyat, barulah rakyat dapat menilai sendiri sama ada perjanjian ini baik atau tidak.

Pada ketika ini dalam keadaan saya tidak mendapat maklumat, saya hanya boleh mengajukan beberapa persoalan penting seperti berikut:

1. Kos penstrukturan RM7.45 bilion yang diumumkan Tan Sri Khalid Ibrahim itu bukanlah kos sebenar yang akan ditanggung oleh rakyat Selangor kerana ia tidak termasuk kos mengambil alih Splash. Tawaran terakhir Tan Sri Khalid Ibrahim kepada Splash adalah sebanyak RM1.851 bilion (tanggungan hutang dan pampasan liabiliti) iaitu hampir sama dengan jumlah RM2 bilion yang kononnya berjaya dikurangkan oleh beliau hasil perjanjian pada hari ini. Saya beranggapan kos sebenar hanya diketahui selepas pengambilalihan Splash selesai.

2. Pengambilalihan Splash besar kemungkinan akan dikendalikan oleh Kerajaan Persekutuan sekiranya akta digunakan atau melalui rundingan terus dengan Kerajaan Persekutuan. Ini bermakna Kerajaan Selangor sudah hilang kawalan dalam menentukan kos keseluruhan penstrukturan semula industri air kerana rundingan dengan Splash akan dikendalikan oleh Kerajaan Persekutuan.

3. Jika kos keseluruhan penstrukturan melebihi jumlah RM9.65 bilion yang mula-mula diumumkan oleh Tan Sri Khalid Ibrahim kerana akhirnya bayaran kepada Splash yang dirundingkan atau diputuskan oleh mahkamah adalah lebih tinggi dari yang mula-mula ditawarkan, apakah rakyat Selangor akan menanggung bayaran yang lebih tinggi ini?

4. Bagaimanakah kawalan pengurusan ke atas syarikat baru pemegang konsesi nanti? Adakah ia akan dikawal bersama oleh Kerajaan Persekutuan dan Kerajaan Negeri? Adakah kuasa Kerajaan Negeri muktamad?

5. Apakah senarai aset-aset Kerajaan Negeri (tanah, loji dan lain-lain) yang diserahkan kepada Kerajaan Persekutuan demi memeterai perjanjian ini?

Sesungguhnya, ada seribu satu soalan yang boleh ditanya selagi perjanjian ini sulit dan dirahsiakan. Tindakan merahsiakan perjanjian dan merundingkannya di belakang wakil rakyat dan pimpinan Pakatan Rakyat tidak ubah seperti bagaimana perjanjian konsesi dengan Syabas dan Puncak Niaga mula-mula dimeterai dahulu.

Sebab itu selagi perjanjian ini rahsia, rakyat hanya mampu meneka dan tidak boleh membuat sebarang penilaian mengenai baik atau buruknya.

Ketidaktelusan inilah yang menimbulkan keraguan terhadap Tan Sri Khalid Ibrahim selama ini.

I am not sure if Anil really read through these so-called concerns by Rafizi and Charles. Rafizi is actually asking Khalid to get the agreement approved by the Pakatan Council. Why would Khalid need to do this when he’s supposed to be MB of Selangor and accountable to the people of Selangor and NOT PR in matters pertaining the state administration. Does LGE do the same in signing agreements ? Does he ever make public all the numerous and (allegedly) shady agreements that he signed in selling off state lands ? Tunglang, you are right, in the beginning he was a ho lang (good man), save heaps for selangor but towards the end, he changed to become a chao lang (bad guy)…

Now, everything is clear….

We can all see human’s ugliness in the person of khalid, the ex mb of selangor, he wont be the last…

I remember one smart guy who rebutted me and said, so what if they implement hudud and an islamic state, I will still vote them to kick out the evil of BN UMNO. We have seen the devils in the MB episode. Like I said, before Rafizi or Tony open their mouth, check on what they have been doing firts. Selangor Wanita MCA wants to know why DAP and PKR are keeping quiet on the raising of the Bumiputera housing quota by some local councils from 30% to 50% and even 70% in some cases. In the water deal, Khalid shows everything is in black and white for all to see unlike the DAP state govt that does not show all. He tells you that he has lessen the state debts from 630 million to 30 millions but he did not tell you that PBA assets worth 600 millions have been contra off to the Federal govt.

Let’s not forget PKR’s strategic director Rafizi Ramli’s host of vague reasons for the impending by-election in the wake of doubts and anger over the sudden resignation of then Kajang assemblyman Lim Chin Cheh. Before Rafizi or Santiago open their mouth about lack of transparency, they should have ask about the CAT lack of transparency on the tunnel, swapping of land, why LMC can be sold by developers and at higher than the quoted price and why residents of other state is allowed to buy direct from the developer. Whether he has the confidence of the assembly or not, the matter now is he is the MB….
