MPSP warns developers to bide by regulations

In the biggest such operation by the Seberang Perai Municipal Council (MPSP), four construction sites on mainland Penang were issued stop-work orders on 2 April for not complying with drainage requirements.

These sites had partly contributed to flash floods in low-lying areas in Alma and Machang Bubok (near Bukit Mertajam) in March.

The MPSP wanted to send a clear message: development has to strictly follow existing regulations. The stop work orders were revoked on 16 May after the project sites complied with the regulations. But then, stop work orders may have a limited deterrent effect, as certain developers may actually factor in the costs incurred as a result of such orders (as contingencies, for instance) in their cash flow projections. Sterner action should be taken.

The MPSP says it wants to lift the corporate veil to find out who the developers hiding behind corporate entities really are and scrutinise their track record before approving applications for planning permission.

MPSP Councillor Steven Shim issued the following press statement:

1. Objektif pembangunan ialah kemajuan ekonomi tetapi kita jangan lupa kesejahteraan sosial.

2. Pemaju mesti menjadi corporate citizens yang bertanggungjawab. MPSP mengalakkan pembangunan tetapi, pembangunan mestilah lestari (sustainable) dan membawa manfaat kepada komuniti bukan sahaja keuntungan perniagaan.

3. Kes 4 arahan berhenti kerja (stop work orders) di Alma baru-baru ini patut menjadi contoh kepada pemaju lain supaya memantau tapak-tapak pembinaan mereka bagi memastikan semua peraturan dan undang-undang dipatuhi.

4. Saya telah membangkitkan dalam mesyuarat One-Stop Centre (OSC) meminta MPSP memberikan kertas cadangan mekanisme pemantauan yang lebih rapi. Antara cadangan termasuk:

a) Setiap permohonan baru pelan kebenaran merancang akan mempertimbangkan rekod-rekod kerja oleh pemaju. Rekod pemaju yang melanggar undang-undang ataupun menimbulkan kacau-ganggu kepada komuniti dalam projek yang lepas akan memberi kesan kepada permohonan baru pemaju tersebut.

b) Mengkaji semula peraturan kecil (by-laws) MPSP supaya pertimbangan permohonan oleh pemaju akan dikenalpasti melalui pemilik bukannya hanya melalui entiti korporat. Ini bagi mengatasi kes di mana pemilik mendaftar beberapa buah syarikat bagi mengelakkan rekod buruk semasa menjalankan projek. Prinsip undang-undang begini tidak asing. Dalam undang-undang korporat, telah wujud peruntukan di mana pemilik dan pemegang saham dikenalpasti bukan sahaja entiti perniagaan. Prinsip “piercing the corporate veil” ini adalah bagi memastikan peniaga dan usahawan akan menjadi coporate citizens yang berhemah dan bertanggungjawab .

c) Bagi memastikan projek mengikut pelan yang diluluskan, MPSP perlu proaktif mengambil tindakan berasaskan s70 Akta Jalan, Parit dan Bangunan (Pindaan) 2007, sub-klausa 27 yang memperuntukkan denda tidak melebihi RM250,000.00 atau penjara tidak melebihi 10 tahun atau kedua-duanya.

The Penang Island Municipal Council (MPPP) should take the cue. The MPPP must ensure that developers strictly abide by regulations and guidelines forbidding development on sites exceeding 250 feet above sea level or on slopes with a gradient of more than 25 degrees.

Go to Jalan Paya Terubong opposite the Hokkien graveyard (after EconSave) and turn left into Lebuh Rambai at the famous Hoo Tau Bee Hoon night stall and you will see another ‘botak’ hill being raped of trees. This one is more than 25º and looks dangerously ‘botak’ of trees.

MPSP better stop your warning as this is unfair to other less connected developers. If your cousin MPPP can allow hill slope development, then stop complaining about minor flash flood until there is people die from it.

Otherwise … Lim will issue more BIADAP statements.

Funny, never heard a single biadap statement from Lim. Heard plenty from your end during the last debate. I admire Lim for not breaking out into laughter. I would have, the minute I saw that face.

Big guns always get warnings, postponements, the best lawyers, the maximum appeals, and even changes to regulations to favour them. Small fry get immediate fines or even imprisonment. This is modern-day “democracy”.
