The Penang state government insists it has not approved any new projects above 250 feet since 2008. It must similarly clarify if there have been any approvals for projects below 250 feet on hill-slopes that are more than 25 degrees in gradient (i.e. Class III and Class IV slopes).

PETALING JAYA: The Penang Island Municipal Council (MPPP) has had to approve 19 projects after 2008 because they were deemed as special projects “that could not be rejected” despite exceeding the 76m height limit.
MPPP president Patahiyah Ismail denied that she had contradicted Chief Minister Lim Guan Eng on the controversial hillslope development issue.
“MPPP wishes to reaffirm that all projects carried out 76m above sea level were approved directly or as special projects before March 2008 by the previous state government.
“The Penang chief minister is correct in saying that the present state government has not approved any hill projects above 76m post 2008.
“For those 19 approvals after March 2008, planning approvals were based on the approval of Pelan Dasar Perancangan dan Kawalan MPPP by the State Planning Committee on Sept 13, 1996, and as special projects in accordance with State Structure Plan 2020, which could not be rejected on the basis that it exceeded the 76m height limit,” said Patahiyah in an email to The Star yesterday.
An article published in The Star yesterday pointed out that while Lim had claimed he had not approved a single project above 76m, Patahiyah had said that between April 2008 and May this year, a total of 19 such projects were approved.
She also pointed out that a claim by Penang resident Ong Eu Soon in the same article that a high-rise project in Air Itam was approved in 2009 and sitting well over 76m above sea level, was untrue.
She insisted that the Air Itam project was approved in 2005 and asserted that it was only 56m high.
The Star was quoting from documents handed out by MPPP during a press conference on June 6.

As a people-centric government that listens to the people, we have listened to the people who values the safety to their families by strictly imposing a building line at 250 feet which is half of the 500 feet set by the Federal government. Projects carried out above 250 feet are either approved by MPPP before March 2008 or for those after March 2008 consist of “special projects” approved by the previous state government on 13.9.1996 which MPPP can not reject as long as technical requirements are met.

In its enthusiasm to lynch the Penang PR state government, Star has ignored the fact that the Penang PR state government did not approve any development projects above 250 feet . At the same time, the MCA-owned paper makes the startling claim that there are PR or DAP assemblymen who agree with the Star that the hills in Penang are dying under PR’s stewardship. Nothing can be further from the truth.
From day one I am arguing that we should not just ban hill slope development based on the height criteria. I am arguing we should scrutinize all hill slope developments as long as they exceeded the gradient of 25 degree. It is Lim Guan eng who insisted that hill slope development should be confined to the 75m limit.
I have King Kong telling me off in Anil’s blog that even in low lying areas there are plenty of slopes for which I totally agree with his King kong brain!

I already said it very clear even if Koh Tsu Koon administration ever approved those 10 projects, the approvals already lapse long long long long long long long long long long long long long long long long time ago!

Koh Tsu Koon administration approved those 10 projects and with the next administration in place, its just a takeover and continuation of the project. You cannot simply stop a project when you take over the government. To imply it lapse is not correct.
