The Penang state government announced this morning that it has no choice but to take the federal government and the Election Commission to the Federal Court to compel them to restore local government elections.
It wants to bring back elections for the Penang Municipal Council (MPPP) and Seberang Perai Municipal Council (MPSP).
In May 2012, the Penang State Legislative Assembly passed the Local Government Elections (Penang Island and Province Wellesley) Enactment 2012, which allows for the Election Commission to conduct local government elections in Penang.
The state Government then informed the Election Commission that the Enactment would come into force in Penang by 31 January 2013. But it failed go get a commitment from the Election Commission to conduct the polls.
Joining the statement government in the suit is P Ramakrishnan, the immediate past president of Aliran, who will be the second plaintiff. Rama, who has voted in elections since 1964, also wants local government elections to be restored.

The Enactment would only come in force by 31 January 2013. Before 31 2013 the govt cannot simply act against or sue the EC but after 31st Jan the govt has the legal basis to sue them. Before making any comments against think twice
Yang: But why did it take so long to get the legislation? Ultimately PR has been in power for nearly 5 years and they’ve had all that time to get the legislation in place and force BN and the EC’s hand but it took them to now. Did it really need to take this long?
Rama should be ashamed of himself, if he really serious he should sue the government earlier not just before election. What happen to the confidence of defeating BN? Why not wait until the election is over? Is this just an election gimmick? So we can see its not the state govt that fail the people. Its the Federal govt and EC that is the obstacles just like the water issue in Selangor.
