At a press conference now going on at 5.30pm, P Balasubramaniam’s lawyer Americk Singh Sidhu has cast doubt on the private eye’s second statutory declaration.
After spending hours with Bala taking notes of his testimony previously and being familiar with his character, Americk said, “I am very sceptical that he has signed the second statutory declaration of his own free will and I am convinced he has been intimidated to do so by either threats or promises, as I can think of no other reason.”
He said Bala had signed the first declaration in front of a commissioner of oaths – someone whom Bala recognised as having grown up in the same Slim River neighbourhood as himself – on his own free will.
“I am therefore extremely surprised that Mr. Bala, in the space of 24 hours, has engaged the services of another lawyer and affirmed another statutory declaration swearing the first one was untrue and that he was forced to sign it,” said Americk.
The last Americk saw Bala was in Americk’s office after the press conference. Bala said the police were trying to contact him over the phone. Americk then told Bala to talk to them since they were trying to reach him.
Bala then spoke to the ASP and left at around 4.45pm. Americk assumed he was going to meet the ASP at about 6.30pm as they had been talking about having fishhead curry at Brickfields, said the lawyer.
Bala didn’t seem to be apprehensive about the ASP; he seemed to know him quite well. From the conversation on the phone, Americk said it sounded jovial and happy, and the ASP seemed happy that Bala had made the SD.
It sounded like the ASP wanted to see Bala to congratulate him for what he had done. “That was the impression I got,” said Americk.
Americk said he had spent a few hours each on two or three earlier occasions talking to Bala and taking down notes. “He gave me the impression that he wanted to do the right thing.” His impression was that Bala was trustworthy.
To a question from reporters, Americk confirmed that he doesn’t belong to any political party. “I am totally apolitical and I am only concerned about what is right.”
PKR vice-president Sivarasah Rasiah said the question wasn’t relevant as Americk was there in his capacity as Bala’s lawyer.
“I am very troubled that last night, one way or another, and true to Mr. Bala’s concerns, another crime was committed,” said Sivarasah. The crime was something which caused Bala this morning to retract the statements he made on 1 July 2008 and revealed publicly yesterday, he added.
“In particular we have taken notice that line by line the specific statements that were revised in Bala’s new statement have selectively removed those which specifically implicate the Deputy Prime Minister by name,” said Sivarasah. That crime could be intimidation or inducement, he pointed out. “It is important for us to reject that message of intimidation.”
Americk’s lawyer who was also present said that Americk was carrying out his duties as Bala’s lawyer and reiterated that the first statutory declaration was voluntarily signed before the commissioner of oaths.
Just before the press conference ended, Sivarasah said people could judge for themselves from Bala’s expression and demeanour when he was telling the truth – yesterday or today.

Now does it not look odd that Americk Singh ‘dropped’ his client at the police station and then sped off, instead of being by his side, to ensure the police could not have intimidated Bala?
Sounds like that famous call by that USA General from West Point to his troops in Vietnam, ‘chase the gooks all the way to hell, we’re right behind you all the way, MEN!’
Barring that quirk Singh will have some explaining to get out of, the SD retraction and re-issue raises more questions than providing clear answesr. We seem to have one of the most pro-active (when it suits them)and persuasive police force in the world.
AS for the dpm, he is not quite out of the woods yet. How come he first said only his asst. met that sighing fool and he only accommodated a photo request, but conveniently forgot to mention that private tete-a-tete at his house. How did that sighing fool find a back-door entry to the dpm’s house just like that? And the dpm ony offered him synpathies but no solid avenue for JUSTICE?

It is better to admit the wrong rather than continue to spin and spin.
Why is Anwar not at the Press Conference just now on the retraction of Bala SD. He left Sivarasa, Americk and Manjit Singh to be the puppet to answer the journalist. Why is Anwar running away from the PC? It was difference when Bala made the initial SD, where PKR MPs attend in full force.
This is troubling for a PM in waiting?
He hide at the Turkey Embassy when Saiful made the sodomy police report. And he dare not face the media at the Press conference.
He need to display some better quaility of a leader.

It’s obvious what happened when he went to see the police at 4.45 pm that day after the PC. He (could have been) coerced into retracting everything about Najib. (Perhaps) that’s why Najib appeared cool and calm and smiling at 7.30 pm when he faced the press on Thursday evening?
How do you coerce a person into saying anything? You can threaten him or you can give him money. With the right amount of money, anyone would succumb.
You couldn’t imagine how low (anyone) could stoop to get away with crime.
This is the ultimate test of what the government would do to stay in power… Until yesterday, I thought there was still hope for Pakatan Rakyat to bring justice and freedom to this country. But today’s episode tells me that there is no hope anymore.

My personal observations;
1.I am shocked to know about the revelations done by PKR. On second thoughts, and after deep thinking, these are only ‘hearsay’. Anyone can say anything and accuse anyone but the onus is to proof them. Is this party good at responding to words of say?
2.If the private investigator (PI) had used the PKR platform to announce what he knew, how come PKR never stand by him during his ordeal in the police station? Like candle light vigil which they usually do? Are they practicing discrimination already?
3.Only the lawyer confirmed he dropped the PI at the police station. Can anyone confirm how long he was there? I still find it hard to accept how a reputable lawyer could just ‘dropped’ his client at the police station after a ‘sensational’ public announcement!
4.I wonder did the lawyer concerned inform PKR personnels? If yes, why no follow up and information being passed around? If not, why? This questioned the responsibility of the lawyer and the party concerned. Can I assume that the witness is no longer relevant after the announcement? Is this the REAL attitude of the party people?
5.Could this be another drama to put the authorities in the bad lime light? Another strategy to gain political vote?
6.As a Rakyat, I like the idea of the petrol reduction once they are in power. However, they did not reveal how much are they reducing. Three sen per liter? Five sen per liter? In my humble opinion, they got to be more specified in whatever they say in the future. If it is RM1 per liter, then I believe this is the Rakyat party otherwise it will be just another political party.

Simple … just ask yourself which SD is more reliable, SD1 or SD2. Must choose, not allowed to say both unreliable. Now, which one?
On SD2 – why is it so important that all references to Najib were removed? Under duress or not I don’t know but there must be something that motivated Bala to do both SDs.

he says..she says..but how could the lawyer not be curious that the ASP “seemed happy that Bala had made the SD” – just sounds odd to me. I suppose whoever who planned this had it backfired on him. Maybe Bala was thinking of those young children of his when he made the decisions to retract..he’s just a pawn in this high stake game after all.

Here is a well educaTED advice to all PKR and pakatan leadership.
Next time a Bala makes a statutory declaration, MAKE SURE YOU HAVE AT LEAST 100 witness complete with AT LEAST 10 video cameras, focussing on all direction, namely
1. Balas pen as hie sign, to see if its shaking
2. Bala’s face to see if its under duress
3. Bala’s whole body to study body language
4. All the people around him to show there is no gun pointed at his head
5. another camera pointed at the faces of lawyers watching him sign and make statements
6. A camera focussed on both Bala and Anwar
7. Another vediocam focus on all surrounding to see if their are cops or special branch monitoring the events, if they hide their faces… they are sure spies.
8. Another came monitoring all the ceilings and walls in case these also have eyes and ears
9. Another one monitoring Balas wife and family while he makes his voluntary declaration
10. lastly a roving camera to spot anything else extraordinary at that time…
Then if Bala makes other declaration at different venues afterwards, all that will be invalid.
and post all the videos in the U tube and other sites hosting videos
HOWEVER if this Bala really was SPEAKING, DECLARING WITH A FORK TONGUE… then I am very sorry guys…

let a neutral body investigate both the first SD and the second SD. Bala is not insane to come up with the first SD. there must be some truth in it as he was the man all along with razak baginda. he should know the script well. americk and sivaras do not need to educate themselves as they are lawyers who were just stating what transpired out of the SD and what happened next. you don’t have to be a lawyer to understand the grand drama involving the murder of this poor mongolian lad. justice has to prevail. the police no 2 has said that they are going to investigate both. why? (perhaps) he could sense somwthing fishy with the second SD. please for god sake investigate and come out with some truth or otherwise. it must be a truly impartial investigation involving disintersted parties.

The entire nation of people are all rilled up. There are for and against arguments to the day-to-day sendiwara unfolding.
