Blow to democracy: Police enter the Perak State Assembly this afternoon

I ran into Sivakumar a couple of hours after he was literally dragged out from the Speaker’s chair in the Perak State Assembly by police and other officers. He looked relaxed after what must have been the most difficult day of his life.

“The Dewan was full of police,” said Siva. “I was taken to a room that looked like a changing room in the Dewan.”

Another Adun, Yee Seu Kai (Pokok Assam) told me there were close to a hundred police and other officers, mostly in plain clothes, in the Dewan this afternoon.

  1. UMNO and the PDRM had just (undermined) whatever was left of democracy in our nation. No police officer should ever enter the Dewan, whether its Negeri or Negara. This sort of action then begs the question: would they even respect the wished of the rakyat if UMNO/BN gets thrown out in the next GE? And what about the monarchy, would they remain above politics? The problem is the rakyat are too divided racially and culurally. If the rakyat are united, we can always get the BN out and force our country to embrace a new order – respect for the law, impartial justice, incorruptible police force and government machinery – but the trouble is there are sections of the rakyat who still purchase the bankrupt policies and filth of Barisan Nasional. Its so sad to see my country slide steadily into the abyss of lawlessness.

  2. Good old Prince Siva, you’ve done your courageous bit – for now! If it weren’t for Jibby “Pink Lips” Razaksasa’s klutzy power grab the rakyat would never have known what brave and great souls we have in the Pakatan state government of Perak! Hope to meet Sivakumar someday so I can give him a big hug :-)

  3. Dear readers, when people are too greedy for power, they lose justice by nature.. wish for a more peaceful Malaysia. If the leaders cannot tolerate peacefully in ONE ROOM… there’s no way ONE MALAYSIA will be a meaningful slogan among thousands of cosmetics slogans in this nation…

  5. Technically malaysia had become a police state when police entered the dewan and forcefully removed the legitimate speaker.

    I am surprise that the bn went through all the unnecessary motion to try so hard to appear legitimate. Why don’t they just grab everything by force and at least be honest about it.

    When our DUN don’t even respect the very basic tenet of democracy can the rakyat now do the same ?

  6. Now this is where it gets interesting below. Can lawyers look at Perak Standing Order 3 and 4 and interpret it.

    Here it says what shall be done whenever there is a vacancy for Speaker. But there was no vacancy. The position was filled. So under what provision did they remove him? Did they even remove him then? Did they vote him out?

    Perak Standing Order 3 and 4
    3. Whenever there is a vacancy in the office
    of Speaker whether as the result of a dissolution of Assembly or otherwise the
    Assembly shall, as soon as a quorum is
    present, proceed to elect a Speaker.

    4. The procedure for the election of a
    Speaker shall be as follows:
    (1) Every member who wishes to propose
    a member for election as Speaker shall
    ascertain previously that the member is
    willing to serve if elected, and shall notify
    the Secretary to Assembly of his
    proposal in writing at least seven days
    before the meeting.
    (2) A member addressing himself to the
    Secretary to the Assembly, shall propose
    some other member then present to the
    Assembly for its Speaker. and move “That
    ……………………………………… (naming
    the member) do take the Chair of this Assembly
    as Speaker”. The proposal shall be
    seconded but no debate shall be allowed.
    (3) if only one member be so proposed
    and seconded as Speaker, he shall be
    declared by the Secretary to the Assembly
    without question put, to have been elected.
    If more than one member be so proposed
    and seconded the Assembly shall proceed
    to elect a Speaker by ballot.

    And it goes on.

    The other point that seems to have been missed is that the speaker has to be a member. From this I would assume that he has to be a member of the house, i.e. a State Assemblyman. The person who was sworn in isn’t even an elected rep. So has Perak assembly even had a legal sitting today? I very much doubt it. Which means that in 1 weeks time, all the bn seats shall be vacated, and we should see fresh election in the bn seats in Perak.

  9. Malaysia has plunged into a nation of NO LAW, perhaps in the ranks of Somalia.
    I was back in Penang recently and observed LAW AND ORDER is NOT RESPECTED at all. You can see motorcyclists jumping red lights, cars parked all over the place creatng traffic jams, buildings and cars are vandalised, residential houses being turned into commercial premises (even lawyers’ offices are housed in residential premises), heavily tinted cars, hawker stalls sprouting everywhere, rubbish everywhere, littering, taxi drivers who do not use meters, illegal parking attendants, motorcyclists riding without helmets, and the list goes on.
    It seems the most important is every Malaysian’s mind is to have $$$ as it can “selesai” everything!!!!

  10. How is it when Karpal Singh was manhandled in Parliament recently, the blue … were unable to do anything to help and now they can interrupt the Assembly to drag our Heroic Speaker Siva out??

    This is so double standard of UMNO/BN evil govt.

  11. BN’s image is gone and democracy is buried in this kingdom. The people will never forget this. They will come up strong against BN. It’s not a defeat for PR but a victory to justice. The battle has been fought and the war has not been won yet. People have become wiser with this incident. Let’s pray for PR and BN to practise true democracy when they are in power.

  17. I am truly ashamed that such lawlessness can take place in my beloved state. Our leaders should be aware that our rakyat are educated and are able to differenciate between righteousness, misdeeds and double standards. The scenario today with online news is totally different from what we had before. People are well informed and understand the law. We also have upright and renowned Judges who interpret and explain the law in simple terms to the rakyat. The battle appears to have been lost but the war is coming in 2012 or 2013. All parties should accept the decision of the rakyat in the next GE and not resort to unacceptable dirty tricks.

    The leaders of our state should have more respect for the Judiciary. The power grab has occured even before the court can decide who is the legitimate Menteri Besar !!! Or is the decision of the Federal Court a foregone conclusion?

    In the meantime, we salute our Speaker, YB Mr. V. Sivakumar. We are truly proud of you, Sir. This is only a temporary setback.

    The police refused and could not act to protect YB Mr. Karpal Singh in Parliament when he was hassled by UMNO guys. The IGP announced that police could not enter the sanctity of the august house. How could they go into the Pk State Assembly today ???

  18. Mr. Siva Kumar, to me you are still the Speaker and one very brave man. Malaysians who respect law and order (nothing of that in Malaysia)know that you did no wrong. MB Nizar and all the other Pakatan aduns and MPs are also to be saluted for syanding up fpr democracy.

  19. The PDRM must make it clear once and for all.
    Can they or can they not enter Parliament or a state assembly?

    The last time they said they cannot enter Parliament when Karpal was confronted by UMNO youths.

    This time around, they were there by the dozens in the Perak state assembly building.

    Which is which?

    State governments of Selangor, Penang, Kedah and Kelantan, be better prepared. Your turn may come next, now that the evil forces think that they have gained control of Perak state government legally. They may want to do the same, starting with Selangor? Remember who is the UMNO head for this state?

  23. Ganesan is not an elected adun ,he has no business in the Secretariat building, He should not be allowed to go in.

    Has he violated the injuction?

    Why was he not arrested?

    On the other hand, why ordinary people who are in black, while sitting in the restaurant are being arrested?

    What have the police done in curbing the criminals from killing innocent pregnant mothers?

    What are their core duties?

    ONE MALAYSIA, yes, indeed ONE BLACK MALAYSIA.

    These goons will never change, and they never want to change.

    Only their slogans changed.

  25. Now everyone has seen what happened and I must say, should not be a surprise. Was there any doubt before this day that those in power are abusing the power given to them by the people?
    The abuse is so blatant and right in our faces and reads a big ‘SO WHAT!!??!!” Yes, so what? We can complain and rant and threaten to so and tell them to watch out for the next GE. By that time, they would already have emptied the coffers…. Do you think they care if they will get re-elected?? This is not really about power. It is all about money.
