Aliran president P Ramakrishnan has come up with an apt response to Syed Hamid Albar’s statement. He is asking the Minister why Saiful’s police report has not been revealed to Anwar. Why is it so difficult to show Anwar the report? Good question.

In a rhetorical stance, the Home Minister Datuk Seri Syed Hamid Albar posed this question to Datuk Seri Anwar Ibrahim, “What is he afraid of?” Aliran would like to pose this very question to Syed Hamid, “What is he afraid of?” Why are they afraid to release the police report lodged by Mohd Saiful Bukari Azlan against Anwar Ibrahim on 28 June alleging sodomy?   1. I am not a lawyer but why should the police reveal the police report made by Saiful ? Does Anwar have the legal rights when he is not even been charged ? People tend to forget that he is just being investigated and NOT charged (yet).

    I am also highly disturbed by the behaviour of Bar Council who seems to taking sides and also defend their members rather than being nuetral and side the law.

  2. The only thing that I can think of is a fix up. Too many questions.

    Why isn’t the police report of Saiful released, what are you afraid off if you don’t intend to manipulate or change it.

    You have Anwar’s DNA profile, it must be on the database, use that to make a comparison, why do you need a new sample. What happened to the ols sample, with todays technology (mitochondrial), even a ten year old sample can yield a DNA profile. But then again, you have the DNA profile on record. What is going on, why so desperate for sample till the point that the Deputy IGP does not even want to address this question

    What a mockery, can someone get a proper foreign forensic expert to give report on this to show that all of this is bull?

    Or send the evidence and Anwar’s DNA to a acceptable foreign agency like UK to do te comparision, this will at least result in exclusion.

    You see, DNA is a signature, who put it there is another story. This is probably what bothers Anwar and his reluctance to give a DNA sample

    Deputy IGP: Why Anwar not given copy of police report

    KUALA LUMPUR: The police will give Datuk Seri Anwar Ibrahim a copy of the police report lodged by his former aide alleging that Anwar had sodomised him “if and when” Anwar is charged in court.

    Deputy Inspector-General of Police Tan Sri Ismail Omar said police could not give him a copy now as investigations were still in progress.

    “Whatever we do is strictly in accordance with the law. Section 51A of the Criminal Procedure Code (CPC) clearly stipulates that.

    “There have been so many allegations and accusations hurled against us in this and other matters, but as far as we are concerned, we will continue to be professional in our approach and carry out our duties according to the law,” he said.

    Section 51A of the CPC, titled Delivery of certain documents, reads as follows.

    (1) The prosecution shall before the commencement of the trial deliver to the accused the following documents: (a) A copy of the information made under Section 107 relating to the commission of the offence to which the accused is charged, if any; (b) A copy of any document which would be tendered as part of the evidence for the prosecution; and (c) A written statement of facts favourable to the defence of the accused signed under the hand of the Public Prosecutor or any person conducting the prosecution. (2) Notwithstanding paragraph (c), the prosecution may not supply any fact favourable to the accused if its supply would be contrary to public interest.

    On Thursday, Anwar lashed out at the police, saying that they had not given him a copy of the police report of the sodomy allegation made by his accuser Mohd Saiful Bukhari Azlan.

    He questioned why, despite repeated requests, the report was being kept from him and his lawyers.

    “Is it so that they can keep amending and amending and amending it to fit in with the statement that I have just given to them?

    “If they give the report to me now, how am I supposed to know that it is the original? Are they waiting to make up the ‘perfect’ police report?” he asked, adding that each time he sought a copy, the police said they had been instructed against giving him the report.

    The Deputy IGP rubbished as baseless and unfounded Anwar’s allegation that police would fabricate evidence against him using his DNA, as he claimed they had done 10 years ago.

    He added that Anwar should be more responsible about making such statements or allegations.

    Could you please get someone to ask … Syed Albar and Khairy to show us how to give “DNA sample” to the police??

    Do they carry their “sample” with them in a bottle, or in their wallet, or wear it like their clothing? Does DNA comes in sample form or in print form?
    You get my point right, how stupid the UMNO leadership and their police … think the rakyat are?

    They want my fingerprint sample? theres a copy in my IC, or give me a piece of paper, I do it myself, and I signed and put the date and place very near to my fingerprint…No problems for me, U police have a problem with that????

    If I am Anwar, I will go to a reputed lab, give them some tissue and get a printout of the DNA Profile… I will even publish it. This one you cannot plant on crime scene or manipulate. Anwar should deposit another copy with the united nation’s scientist and see if his DNA profile changes as he gets older.

    The point is, these are the kinds of “oxford educated” leaders we have in Malaysia. No wonder the way they managed our economy is making the Rakyat suffer.

    It’s obvious why the will not make public the Report. The last time around, they confiscated the diary and then changed the date of the ‘offence’ once, and when offered the perfect alibi, they changed the date of ‘offence’ again. So, if you expect principled conduct from the officers, you can forget it. And since they already have DSAI’s DNA from 1998, why the hoo-hah over DNA now?

    No they have to show probable cause and cannot expect anyone to posibly incriminate himself. My gut feeling says other than that fool’s ‘confession’ they have nothing else to go on, in which case they should do the honourable thing and close the investigation. That they are not willing to do this (suggests) behind the scenes ‘invisible hand’ at work!!

    I personally do not care whether DSAI committed sodo mee, hokkien mee,wan ton mee, cantonese mee or screwed a hump-backed Quasimodo. That is his private affair. I dare say that if we scrutinis the private lives of our politicians, more than half of them would have to be put behind bars, and if we put their financial wealth as well under the microscope, we would have to string them all up by their goolies.

    What we want is the quickest exit of a very corrupt and racist regime that has long gone past the point of redemption.

    And DSAI is making all the right noises that gives many the confidence that if he comes into power, we are in for a period of Renaissance. I am willing to take that risk after putting up with 4th rate governance for over 20 years with now the rise of People Power (Makkal Shakhti).

It is (possible) the denial is to cover up, and perfect the report to take into account details from the various police statements….
    why are the lawyers not taking the case to the court to demand the police provide the report which should rightly be made available to DSAI being the accused. this smacks of another conspiracy

  17. What do I afraid of give the Saiful report?
    If I give you now, than it would be impossible for me to change the report. But DSAI have to give me his DNA, than I (could) draft the report and make the evidence to match with the DNA.

    So, DSAI have to give me the DNA first, else we will use warrant/court order to get the DNA.

    I haven’t seen any ‘real’ economist commenting on the good thing about reducing fuel price. Can you give your opinion?

    As a layman, I think when the fuel price is reduced (of course the goverment can afford to) it will significantly making our economy active which i think is good.

    When more money enters the economy to satisfy the increasing economic activity it will surely making Malaysia to be more competitive. Since other country in this region are facing difficulties i think this should be the right time to surpass them.

If police could not furnish the reports after so many weeks, it shows that Syed Hamid, being the Home Minister is hopelessly in efficient. In this modern age, report can be faxed, email and what have you within minutes after the report is done.

  30. We ordinary folks not implicated in gangb@nging Saiful do not need to see the police report. After all the nessasary details have been published in all blogs and the Govermment controlled MSM. Fact are
    Saiful was forcefully sodomised several times.The last being a “couple” of days before making the report which was a “couple” of days after he sought the advise of the DPM. According to the facts we have read and the accidental blurt from the DPM who first denied ever meeting Saiful, a “couple” of days = 1day.I dont think theres any need to highlight the other obvious doubts any person with an IQ above 10 is having about this whole saga. The main question is regarding DNA evidence now. Im no expert in the field but im sure all in the know will agree that a new sample is not needed since they already have it. True? Unless Anwar is some sort of mutant , as far as i know DNA structure doesnt change. The information should be in the PDRM database. The only other reasonable explanation is that our super efficient PDRM lost or threw away the sample.

    Loh: PKR rep’s aide punched me

    PETALING JAYA: Kelana Jaya MP Loh Gwo Burne from PKR has lodged a police report that he was assaulted by a man believed to be the personal assistant of Seri Setia assemblyman Nik Nazmi Nik Ahmad from the same party.

    It is learnt the alleged incident occurred during the ground-breaking ceremony for a place of worship at Desa Mentari here at about 3pm.

    Residents living in the area had protested against the construction of the building there and Loh, who was present, had approached them.

    After speaking to the group, Loh approached the organisers of the function to discuss with them the protesters’ concern when he was allegedly punched in the face by a man believed to be an aide of a fellow PKR member.

    Assaulted: Loh showing how he was punched by a fellow party member’s aide over a dispute on the construction of a place of worship in Desa Mentari yesterday.

    Police, who were present, kept the situation from getting out of hand.

    OCPD Asst Comm Arjunaidi Mohamed confirmed the incident and said Loh was sent for a medical examination after he lodged a report at the Sungai Way police station.

    He said police have brought in the aide for further questioning.

    “We have yet to receive the medical report and have classified the case under Section 323 of the Penal Code for assault, for investigation purposes,” he said.

    When contacted, Loh said he went to the scene after being informed about the protest.

    He said he was surprised because the matter was supposed to have been resolved on Thursday.

    He said the problem started two weeks ago when residents complained about construction of the building and he was unable to find out who was responsible for the construction.

    “When I arrived there today, I kept on asking him (the aide), ‘Who was responsible for this?’ I must have asked him about 10 times and pointed at him saying that, ‘You as a PA should know’. That was when he punched me in the face above my right eye,” he said.

    The crowd then stopped the individual, he said.

    “I do not think I provoked him,” Loh said.

    He added that the party should do something “comprehensive” against his alleged assailant.

    Loh said he has since spoken to the individual and told him that he “was sorry but he had to make a police report.”

    He added that he did not sustain any bruises.

    Nik Nazmi, who is overseas, is also the political secretary to Selangor Mentri Besar Tan Sri Khalid Ibrahim.

  44. It is evident to (many) Malaysians and to the whole world that the police (may not) have a case. Therefore, they (may not) yet have Saiful’s allegations. They interviewed Anwar, found out his alibis, they stripped him naked, measured him, looked for birth-marks and the like… only then will they come up with the Saiful document, with the details inserted (perhaps) retrospective to the arrest? They (could) tailor-make the case to suit Anwar’s circumstances. Remember the first sodomy case? The apartment where the event was supposed to have taken place was not even constructed yet! The prosecution then amended the date and year, with generous help from the judge! What we’re seeing today (could be) just a repeat of those inglorious days!

    you know, i had my brushes with the police in Sabah before, and i can vouch for you, they are really STUPID question, tiada sikul punya..

    and when we make police reports of burglary, those cops cannot even make a simple sketch plan of the crime sites, that we often have to beg to draw the sketch ourselves otherwise the recording of police report will take almost a DAY.

    So how can we trust this uniformed unit any longer????

  47. Without the report being shown, the police is condoning excessive speculation and accusations. Tan Sri Ismail may use a clause to justify this act yet due to the low trust on the police force right now, they could have acted above and beyond the minimal to ensure confidence in their investigation.

    If the PDRM has to release the police report to DSAI based on the law, then please highlight the relevant section of the Criminal Law / CPC(it there are any).

    RPK makes an allegation, he goes to jail.

    Actually, I did not know why we were going to see Najib. Saiful just said that he wanted to go and see Najib and he wanted me to follow him. So I followed him.

    ………..And how will that happen? Well, this time I video-recorded a ‘confession’ session. And the video recording is now in a safe place, ready to surface during my trial when they charge me for this newest ‘crime’, whatever that crime is going to be….
