1300: Kampung Buah Pala residents have not met a noon deadline to accept a compensation offer by Nusmetro, according to a contact at the scene.
In a just concluded press conference, they expressed anxiety over the conditions attached to the offer. They claimed that Nusmetro’s offer itself was illegal as the temporary title to the land in the Koperasi’s name prohibited any transaction.
They also said that the offer of cluster houses was dependent on the developer securing all necessary approvals from the relevant authorities, and there was no guarantee that it could. No buyer in a normal property development project would accept such a condition, they argued.
They were also unhappy at being asked to drop all legal suits.
They pointed out there were 65 families in the village and only 24 cluster homes were offered.
The press conference was held at noon, the deadline given by Nusmetro for the villagers to accept the offer. Earlier, the developer had warned in a letter that it would execute the writ of possession if the residents failed to leave the village by noon.
The villagers had faxed a letter to the Chief Minister yesterday asking for more time to consider the offer. They only received the detailed house drawings after 5.00pm yesterday.
Meanwhile, a small group from Pas, including Kota Bharu MP Wan Rahim Wan Abdullah, visited the villagers yesterday evening.

As much as I sympathised with the villagers’ plight and situation, their greed is eroding my sympathy.. I’m amazed with the rate they’re multiplying by the day.. from 24 families to 41 and now, 65 families? Considering they have no proof of ownership nor do they pay the fees that most of us regular folks do, they sure have it good as compared to the others that was just evicted with hardly any compensation.. Their greed will be their downfall..

Here is a very clear case of “Saperti Belanda Di Beri Tanah”. I hope the state govt will not interfere in this very clearcut case of the “squatter” agst the developer (Supported By BN).
First it was 24 but now 65…and if it drags on again, it will become 98 families becuz I want a share too.
Please accept the offer and resolve the matter as sinc ethe law is not on your side and developers are really ruthless, it is advisable to take what they can give oe else when the demolition starts, you get nothing and only a broken hope. Dont b=lame anyone but yourself.
Given a deal but kept asking for more. Do you guys ever think how the rest of Penang are thinking of you guys holding the whole of Penang at ransom?
Act now before its too late. To those who wish to accept the offer, do not be cowed by those who dont as you may lose everything in this “gamble”. Be sensible and smart.

The initial proposal was to offer them a comparable plot of land in Seberang Perai – which they rejected.-insisted on remaining on the island.
Now offered them double storey terrace hse (which is very costly in Penang Darul Kondo) – they still reject!
Don’t be suprised that when they loose everything – very few people of Penang would shed a tear.
Plus, lost all their recent court cases “WITH COSTS” – which I suppose they will expect the State (and by extension, the People) of Penang to cover.
It is obvious the villagers don’t want to settle -LGE and the state Govt has wasted enough time with this – please get on with governing the rest of the state.

Wonder where is the two super hero brothers and the MIC youth leaders with (their offer to buy the land for) 3.5 million ringgit.
All i could say is the villiagers are just thinking that by repeated the land is theirs the land grant will fall from the sky. If the land belongs to them they just need to proof it. Its the plain truth and it hurts.
Recently the settlement near titiwangsa was demolished by the developers despite there was a proof that the original owners of the land have sold the land twice and made off with the money. Sad but the laws says that the owners of the land is the one who has the land title.
Compared to them Kg Buah Pala people are being treated very well. The problem now is these folks have been mislead by the two super hero brothers and the MIC goons to further their political agenda and this guys will have to pay for their supidity for not being able to disferentiate between good and evil…
They keep making stupid mistake, if you do not hv the legal document then yo do not have any rights whatsoever. to start of the trust just gave them the right to reside by no mention as to them being the legal owner. so in this case they can only blame their forfathers to their mistake.
I do not sympathise them but just angry with their greed and their attitude of keep changing the goal post.

Is this KG Pala a leasehold land or freehold?
If it is a leasehold with tenure of 99 years, then there is nothing to worry.
After 99 years this piece of land will revert to the Govt of the day.
What i suggest is this:
All the bona fide residents of KG Pala must register with the state govt.
State Government will declare that after 99 years the land will return to all the descendants of Kg Pala residents Free Of Cost.
State Govt will issue land title to all the existing residents which will only be valid in 2110!
This will definitely damper the Koperasi move to any developement! Imagine all the houses and complexs in the hands of KG Pala descendants!
Everything depends on the Govt of the day then and whether all these descendants exist or not!
What do you think, folks?

This fairy tale of “Good Guy CM” vs “Greedy Residents” is a spin by the LGE & Co.
Remember, the villagers are NOT greedy. They just want to be left as they are now. They DON’T want any bungalow houses or $$$, all they want is their houses and land that they stayed for almost 100 years. It is the cruel CM who dangles the (developer’s offer) on their eyes to get them out of the way so the developer can start buildlng luxury condos and LGE can go on preaching to the whole world how great a CM he is.
This is a black day for Penang and Malaysia.

As I foreseen, public opinion will turn against the villagers for rejecting the offer. Once that happens, the political pressure on the Penang govt eases and they are left in a precarious position. The villagers may be right to reject the offer but they have my sympathies now.

… it was state owned land which the previous government sold to a private company.
What do you expect the current government to do other than negotiate with developers for better compensation?

I have my home in K.L.(Pertama Complex) demolished without compensation just after May 13 1969.We stayed there for more than 25 years.We have no avenue to turn to under the N.O.C. government.Here in Kg. Buah Pala,the residents are offerred a double house,& yet they are so greedy as to demand compensation for rental,shifting etc.Are they not capitalising on a sympathetic public & the government? I will not sympathise for them if the developers were to demolish their homes.

Maybe K is the one who instigated the villagers to reject the offer. See how he’s gloatingly (criticising) LGE now.
According to lawyers, the housing trust cannot be enforced in perpetuity. When the trust was dissolved under the national land code the land should have been transferred to the Federal govt. Improper procedures may have resulted in the land being sold by the Gerakan state govt but the bottom line is that the villagers do not own the land after the trust was dissolved.
In fact, the villagers had been paying TOL fees for years to the land office which means they were already not the land owners.

(2) THE HIGH COURT HAD RULED THAT THEY ARE SQUATTERS, NOT LAND OWNERS.

I agree with Peter that the person most suitable to resolve this issue is Koh Tsu Koon. And while he is in Penang, he should also come to Batu Ferringhi and explain why he approved all those dangerous hill slope development projects which even now endanger the life of motorists using the Batu Ferringhi coastal road. I promise Koh Tsu Koon that I will be the first to welcome him.

Pls Enough is enough! The compensation is very good. All these are the doings of the previous goverment. LGE has been very good and accomodating to their demands. Let LGE concentrates in his works. If most people in Penang are like them, then LGE can never have time to govern Penang to bring peace and prosperty. There are so many homeless and sick people who suffer in silence. We should be more caring enough to help these poor people. May God heal our land.
