1540: The judge said that a proper application for appeal to the Federal Court has not been filed, reports Jonson. Karpal continues to outline reasons a stay of the sodomy trial should be granted.

1535: The court has agreed with the SG: the medical record is not conclusive and corroborative. The appellant has not shown the charge against him is oppressive and an abuse of the court process. Appeal dismissed.

1519: Anwar’s counsel has forcefully and eloquently argued that the charge is oppressive and an abuse of the court process, according to Jonson Chong at the scene. The judgment is being read out now.

1514: The Court of Appeal is sitting now to deliver its decision on Anwar’s appeal.

Anwar had appealed for a reversal of a High Court decision to disallow his application to strike out the sodomy charge on the grounds that the charge and prosecution were mala fide and an abuse of the court process.

  1. This case is getting me confused! Sodomy, sodomy and sodomy! In this case of sodomy, are both the parties not sodomites and if both of them are sodomites and if sodomy is a crime in Malaysia, why is only DSAI charged and why is Saiful allowed to go scot free?

    Another thing is Saiful is acting and behaving… like film star, … so confident …

    Surely, this trial … more political is it not? Even at the early stage of the trial there had been too many confusions …

  2. Well Saiful is obviously basking in the spotlight, very unlike a young and vibrant male victim. Who knows he might be thinking that this will catapult him into some sort of a political star and even maybe a movie star…

    Who is advising these UMNO top shots? They keep shooting their own foot. This sordid episode is going to be like a bad smell that never goes away and will come back like a twister to haunt them all the way to GE13.

    Is it bad advice or vendetta, often enough vendetta and revenge makes you blind and when you see light again, it is often too late.

    I’m sure out of all these struggles, the resilience and the perseverance we bear, some answers of hope and good news will come forth. All these struiggles will give rise to some unforseen and dramatic changes. I’m optimistic and positive in the midst of the negative news. People have all begun to open their eyes and see. They have also begun to hear. A day will dawn when TRUTH will show itself victorious. If aint than there is no need for faith and trust in GOD. Just as the Red Sea was parted as Egyptian army was Pharoah’s army was in pursui9t of the people, when there was no way out for the people, GOD made a way. I believe in God. HE will make a way for the truthful and honest.

  6. Lim Guan Eng is very much like his dear old dad, Lim Kit Siang.

    One thing about Lim Kit Siang is his penchant on regurgitating the ideas of others, like the one time Lim Kit Siang picked up the “One PC per family” idea from Bill Gates and tried to use it as though that idea was his own. (LKS did that in the 1990s)

    This time though, his son, Lim Guan Eng is doing something rather interesting.

    Lim Guan Eng has chosen to regurgitate the famous uttering of Zhu Rong Ji, regarding 100 coffins.

    Both father and son pair failed to understand that they are nothing in comparison to the persons whom they stole the words from.

    Lim Kit Siang is no Bill Gates. Bill Gates started Microsoft and make it a successful company.

    Lim Kit Siang? If not because of DSAI and the failing of BN, DAP would still be an opposition party.

    And Lim Guan Eng?

    How can this guy start to compare with Zhu Rong Ji?

    Mr. Zhu has done great things for the Billions of Chinese in China.

    LGE, on the other hand, can’t even stop the corruption within his own DAP!…

    And oh, btw, DAP HAS corruption too, just in case you don’t know, Lim Guan Eng !

    Everyone knows it is political… And as you are well aware, in this Boleh Land, apa pun boleh right with the federal govt? Whatever tak boleh, they will make it boleh.

    See Altantuya boleh or tak boleh?

    Anwar was a threat to Dr M, so Anwar need to be put away…

    Now, 308 proves that Anwar is a very dangerous person, why? Because he is PM in the making…

      … Come on, the more you think about it the more stupid the whole case becomes! But, that is politics, ala UMNO Baru/BN.

      Now the revelation that three Muslim ladies had been caned for illicit sex. Do you believe that the UMNO Baru guys are so clean that they do not indulge in illicit sex, molest, outraging modesty of others, consumption of alcohol? What next?… Sickening is the situation.

      As it is, we are already living in an Islamic country, do you think it is not better that we shift to PAS, at least the corruption, the intimidation, the bullying will be less? Do you not agree that PAS is playing its leadership role and deserve to be supported by the Rakyat? If there is no PAS today, all the opposition parties will be trampled at will. Please give some recognition to PAS. If you wish to meet with the new breed of PAS leaders, wait till (Mujahid) Yusof Rawa comes back from the States, we can arrange to have a dialouge with him.

  8. For all those who can’t recall the statement made in the early days… “Saiful was a willing partner who turned into star witness in return for immunity”

    Interestingly during the swearing ceremony in the Masjid, Saiful had categoically stated that he was forcefully sodomized, (by a 62 year old man with a real bad back problem!)

  10. The big picture is this:

    UMNO/BN do not have any sure fire grand plan to win back votes AND PR and PKR no longer can be taken down by any single event including potential jailing of Anwar. What BN can do is do a series of things, most of them negative against PR that can damage it to hold on to power and thwart PR march to Putrajaya. So basically its BN negative campaigning and vast resources vs PR self-improvement and lack of resources.

    The determinant of whether who wins is actually luck vs resources. Luck is with PR, but resources is with BN. The problem with luck is that its an unpredicatable master. The problem with resources is that it can run out. The only way BN can win is that it takes the luck away from PR and how? -Early election, gerry-meandering, voter fraud, even suspending election entirely.

    PR way to win in the end is really to push UMNO/BN to take its luck for granted. It really has to fan the flames for internal fighting within UMNO/BN which is brewing. Its not that hard – they can’t help themselves being the feudal system that they are – its natural behaviour. How do you do it? By denying them the resources they need to spread it around to lubricate the feudal system that they are. So PR need low oil prices and they need to keep pounding on corruption and new taxes from being passed.

    Anwar? Its not that important if they can deny UMNO/BN their resources.

  11. Finally, as in Sodomy 1, it may again, boil down to semen and DNA as “corroborative evidence.”

    Let’s look at a hypothetical situation.

    If I want to frame A for sodomising B, I would take B’s semen and sprinkle that with DNA from A and plant that semen in the anus of B. B’s DNA found on the semen sample would be regarded as a contaminant.

    Everyone will gasp at the notion that since A’s DNA is found in the semen on B, then the semen must be from A.

    In the case of boy/girl rape, DNA determination can be conclusive because there would be DNA from a third (male) party if the semen is planted. Not so in sodomy.

    You argue funny.
    Of course, DAP is not 100% clean.
    Even in Lee Kuan Yew’s Singapore, there is some corruption.
    However, we need to recognise that corruption within DAP is minuscule compared to that in UMNO/BN where institutionalised political patronage is suffocating the resources for development.
    Moreover, DAP is kept closely in check by a partisan MACC.

    First bring all BN run states and authority in this country to the level of Penang in fiscal accountability and transparency.
    Let them be similarly commended by the Auditor General.
    If that can be done, then March ’08 is still not in vain because it shows UMNO/BN is capable of change.
    Otherwise, let’s get rid of them in GE 13.
