Let’s go back a bit and look at the timeline:
3 October 2005 – Nusmetro enters into a joint venture with the Koperasi.
5 October 2006 – Planning permission is given by the local authorities.
27 March 2008 – Temporary title (Borang 11AK) (99 year lease) is registered in the name of the Koperasi. The title contains a restriction saying that there can be no transfer, lease, sub-lease or any transaction.
There are also two caveats shown on this temporary title document:
1) Caveat by Nusmetro – registered on 14 April 2008. (Nusmetro had agreed to pay the land premium on behalf of the Koperasi in return for the joint venture agreement.)
2) “Kaveat Pendaftar atas Tanah” – registered on 22 December 2008. (This appears to be in connection with some loan to a borrower. The Housing Loans Section of the Malaysian Treasury applied for the caveat.)
Can planning permission for a plot of land be given before the title is even registered in the name of the applicant? How did this happen?
And what is the final outcome of the state investigative committee’s probe into the land deal? There is no point revealing the results when the houses are already demolished, is there? No more talk of land scams now?
And what is the outcome of the report lodged by residents with the MACC?

Dear Netto,
I have thought of an idea regarding this issue.
1) Instead of the double storey have 3 stories and the cost for the third storey be shared equally by the 3 parties i.e. Penang state govt.,developer and the residents.
2) The state govt. dont need to spend in millions.
3) The Developer doesn’t need to give any more land.
4) The residents can have an extra floor(600sq.ft)
I tried to contact the state authorites but failed.You may suggest this to them.
This is only my sugesstions.

Please tell this the Kg.B.Pala folks that the State gorv., is helping them and tell them not to demand cause everyone knows that it is the fault of the last gorv. Tell them to go for them why go for those who want to help? Tell them dont be greedy . Since the court has made its ruling nobody can do anything now can you? Tell those folks who are their friends and who are their enemies. If they cannot distinguish between the two nothing can help them. Please take what is offered before it vanishes. Your challenge is a pathetic one. Even based on your twisted logic, you can only speak for your own self and please remember you dont represent the villagers.
By now you should know that almost all villagers have rejected the offer. So if you really do live in KBP as you claim (one which I am highly doubtful of), please take up the offer…no one is stopping you.
The fact of the matter is that the offer of settlement is from the developer and not LGE. The real truth is the CM has no guts or political will to force the developer to move out via his executive power or using the “fraud” allegation that he likes to claim.
Let me tell you what most of us think. It is the former BN started off the issue but the LGE (administration) and his crew finished off the deal… to please the Big Business. That land sale was concluded within days of LGE assuming his CM-ship. (Could this have been) done without his knowledge or approval? If this is not true then he should prove so be declassify the exco meeting minutes atfer March 2008. The speed of the land transfer was done was a world record.
This destruction of heritage will haunt LGE, his exco and DAP forever. Like Khir Toyo and Kg Jawa, LGE will be forever be associated and tainted with the KBP’s demolishment.
Remember, the loss of KBP will be remembered as a shame for all Penangites. And LGE will be personally held responsible. And I am not even talking about Prof Rama, who has less credibility than Samy vellu…

The Indian labour folks have toiled the land to enrich the Brown Dynasty and now the Browns have left and the 100 years labourers have remained unattended…. (They) are just helpless.
Even if they are considered squatters, why did the government of the day ignore their existence and decide to market their 100 years old land and throw them out. The government of the day made them homeless. These fellows aren’t squatters, labourers who lived that day and did not bother for the tomorrow. When the estates were sold and the …labourers cast out, they became thugs of the modern days. Whose making is that? The British for bringing the Indians to toil the land and sow the seeds of rubber trees. It was rubber that enriched Malaya then. While working in the European estates everything was taken care of and the workers did ponder for tomorrow. Suddenly all was taken away with the sale of the estates. They are desperate. They are pushed into crimes for survival. Has their Gods forgotten them?

K, tell us what executive power LGE has to force the developer to move out and what can he do about the fraud allegation now that the court has upheld the land transfer?
Like Hindrf, you keep blaming LGE because the land was transferred 19 days after PR took over Penang. The transfer was done by civil servants behind LGE’s back at a time when the state govt was newly formed, in confusion and moved into offices emptied of all files. No approval was needed from the state govt as everything was already approved by the Gerakan govt.
What is your political agenda, K? Are you from Hindraf or BN?

K is KTK? K is so adamant in condemning LGE who walks into the office where KTK and this thugs had removed all the files. Thru’ the civil services, KTK/BN rush to get the transfer documents signed. Where is the evidence that the Documents were signed with the full knowledge of PR Govt? If that is the case, if K’s relative is caught with drugs, then K too must be punished because it was his relative. Very Logical in K’s World.

many of the posters in the newspaper website are ignorant of what the real issues were. They kept hurling insults of greed and praising lge for his generosity. The truth of the matter was that a wrong had been committed against a disenfrenchised group of people. The state government under pr is about justice and fairness.
Try educating your readers on such notion as justice, fairness and fraud and then take another poll. I bet if you presented a balanced view – legal, political, ethical, economic and a sense of justice and fairplay the poll would see a very different result.

If the caveat have such limitations then this ought to be easily solve .
This means numestro ‘purchase” a land that is useless to them.
But the court’s decision was the other way.
Need to take a look at numestro’s documents before we jumps to conclusion .
As theirs could be a totally different clause.
Have to study the recent court decision on Kg Buah pala too.

Again we have the group claiming that the Kg Buah Pala folks are the land owner but till now i have yet to see any document supporting that. So on the other hand they can be equated to all the indian workers who have for generation worked in many estates that have been converted to housing estates and industrial park all over peninsular malaysia. Sadly many or all of them have been cheated by the BN government, estate owners and the plantation workers union( sadly led by immoral and despicable leaders). At least these people are being offred something instead of nothing that has happen to many ex estate dwellers.
This also raises the other question of responsibility among indians generally with their attitude of not bothering about legalising the land they have been occupying, well being poor and illiterate is not a good excuse. We have many industrialist who was poor and illiterate till they passed. Same thing is happening with registering their childs birth a simple process that need to be done went a child is born but yet again we have huge numbers of childrens without documents here in Malaysia. So stop accusing other for the fault of you and your forefathers. As for the so called social activist stop blaming and start doing simple activities by working at the grassroot in raising the awareness of doing this simple registration processes then telling the world we have been cheated and so on.
