The real deal: Perak Mentri Besar Nizar Jamaluddin below the Democracy Tree
So the High Court has ruled that Nizar is the rightful MB and Zambry and his exco members are to vacate their posts with immediate effect.
Justice Abdul Aziz Abd Rahim ruled that a Mentri Besar can only be dismissed by a vote of no confidence.
This is a brave verdict by a courageous judge.
So where does this leave the Perak State Assembly, which now has “two Speakers”?
In my mind, as in the minds of most right-thinking Malaysians, the only way out of this mess is to dissolve the assembly.
Unless the BN wants to prolong the political mess by appealing the decision. But then, on 23 March, the Federal Court had already ruled that the case should be heard by the High Court.
God is great. Does Zambry now hold the record for “Mentri Besar” with the shortest reign? No, not even that, as he was never the Mentri Besar yang sah to begin with – as the High Court has just ruled and as most Malaysians already knew right from the start.

I hope this decision will not be turned into a horse and pony show where Z will appeal and the Sultan says..wait for the appeal before I make a decision on the dissolution of Perak State Assembly!!!

And where does this decision leave our former Lord President? Egg on his face, no? He should have done the right thing from Day 1. Instead, he now has to bow to a High Court decision. Poetic justice for sure.

mereka akan gunakan isu ini untuk mengatakan mahkamah malaysia adalah adil. memang mereka dah rancang semua ni. lepas ni zambry (mungkin) buat undi tak percaya di DUN. Speaker dah jadi orang mereka. so nizar (mungkin) akan ditendang.
pastu mahkamah yang sama (mungkin) sumbat anwar dalam jail bulan julai nanti.
kalau PR marah, mereka akan tunjukkan PR ni hanya suka bila mereka menang di mahkamah tapi kalau kalah akan tuduh BN menguasai mahkamah lah itu lah inilah dan bermacam komen lagi

I read in Malaysia Insider that Nizar is now on his way to seek the Sultan’s consent to dissolve Perak state assembly. Will he get the consent this time around?
I pray for the rightful thing to happen, i.e. to have a fresh elections. I will go home to vote!

With Msia’s democratic institutions having taking three steps backward since February, today’s High Court decision is two steps forward. The final step is for disolution of assembly and elections.
But still we continue to demand an apology from and investigation on those resposnsible for instructing the “men” to remove Sivakumar from the state assembly hall on 7 May.
Keep harping on the invisible damage to the nation’s psyche and we will soon see an official apology from the government by Merdeka or sooner.

There should not be any allowances for any BN assemblymen to go back into the state assembly or offices as they will cart off tons of document which they approved during the crisis.
Tons of evidence is waiting for PR to pick up to sack the BN assemblymen. Lock all the gates!
Although I won’t be surprised to see PDRM surrounding the State Aseembly now until all the evidences disappeared?

If only the palace had disolved the assembly in the first instant, it would have saved us all the heartache and the ugly fracas in the state assembly and what’s more important they would have retained the people’s respect but sad to say, they have now forfeited that too.

I think what the judge says is that Zambry was never the Mb to begin with. His appointment is void ab initio (from the begining) and therefore, anything done by him and/or his exco is also void ab initio. I would be curious to hear or read the entire judgement, but on the face of it, it seems to be based on sound legal reasoning.

this is really the key. Anil, please triple-check this. If it is so, PR has won the battle as they will trash BN in any election in Perak now.
Otherwise, I’ll run a fast-forward for you: (What if the sultan refuses to bubar again?), BN calls for sitting, votes no confidence and removes MB and Speaker LEGALLY this time.

The next course of action is to bring Hee Yit Foong to court for her illegal usurpation of the Speaker’s position. The fact that Hee cites Article 36(A) without understanding its contents shows how worthless Hee Yit Foong has become.
Pray tell, how did Hee Yit Foong have the power to convene a mini dewan and assume the position of speaker when Sivakumar was still the Speaker of the House, Sivakumar was not ordered by any court of law to relinquish his position and by the very fact that Sivakumar at the time was still physically occupying the Speaker’s chair. So on what constitutional basis did Hee Yit Foong claim her power to usurped the Speaker and pass motions in the state assembly?
The entire proceedings of the state assembly starting from Hee Yit Foong’s illegal act has rendered subsequent events in the state assembly as null and void. And Hee Yit Foong had better learn to shut up fast and stop provoking the rakyat.
Article 36(a):
“During the absence of the speaker from a sitting of the legislative assembly, such members as may be determined by the rules of procedure (standing orders) of the assembly, shall act as speaker”
Hee Yit Foong, when you took power illegally the Speaker was physically present not “absent” as Article 36(a) states. It is you Hee Yit Foong that has gone against the Perak State Constitution and for your earlier betrayal of Jelapang voters, your lies on (the) pepper spray, and your constant provocations against the peoples of Malaysia…we hereby demand that you resign with immediate effect as the ADUN of Jelapang. You can go and contest in Pekan, then maybe you would have a chance of winning!
I highly suggest Pakatan Rakyat immediately launch legal proceedings against Hee Yit Foong to stop BN from convening an illegal vote of no confidence. Haste is required, time is running short!

I think people should not be too quick to think that the judge in question is on the people’s side.
… UMNO will paint us a hypocrites for only saying the judge is fair when his decisions are for us and unfair when against us. Please be aware of the many dirty tricks employed by UMNO.
One swallow does not make a summer. I will reserve judgement on the judiciary until I see a clear pattern of neutrality and not base it on a one-off case.

This has gotten the judiciary some brownie points. What for, I wondered aloud. After all, parachute judge Zaki is firmly ensconced in the CJ’s office.
Ah…. then came the realisation. Anwar’s trial is next month, no? Just be careful about “praise” for our “brave and courageous” judiciary. Those words might yet be regretted in the not so distant future.
Proton and their China partners are in Singapore for arbitration. Why not in Malaysia? Tells you a lot about Malaysian courts. A swallow does not make a summer indeed!
