The real deal: Perak Mentri Besar Nizar Jamaluddin below the Democracy Tree

So the High Court has ruled that Nizar is the rightful MB and Zambry and his exco members are to vacate their posts with immediate effect.

Justice Abdul Aziz Abd Rahim ruled that a Mentri Besar can only be dismissed by a vote of no confidence.

This is a brave verdict by a courageous judge.

So where does this leave the Perak State Assembly, which now has “two Speakers”?

In my mind, as in the minds of most right-thinking Malaysians, the only way out of this mess is to dissolve the assembly.

Unless the BN wants to prolong the political mess by appealing the decision. But then, on 23 March, the Federal Court had already ruled that the case should be heard by the High Court.

God is great.  Does Zambry now hold the record for “Mentri Besar”  with the shortest reign? No, not even that, as he was never the Mentri Besar yang sah to begin with – as the High Court has just ruled and as most Malaysians already knew right from the start.

  3. I am the happiest man in Perak today. Praise the Lord, my prayer has been answered.
    Of course, in an appeal this decision (could) be overturned but then who cares. BN will go deeper into it’s grave.
    In any case Nizar will seek an audience with the sultan. Is THE sultan going to refuse to dissolve the assembly again? Is he going to convene another Assembly…? Is he going to re-interview the 3 frogs?
    THE SULTAN CAN REDEEM HIS IMAGE IF HE WANTS TO.

  5. This certainly is a surprising decision by the High Court. Most M’sians had written off the verdict as a forgeone conclusion.
    Perhaps there is still hope left for the judiciary.

    Obviously now, Hishamuddin, Najib, etc ill come out to say, “See! We do not interfere in the judiciary. They’re free.”

    Let’s hope BN does not appeal the decision and pave the way for fresh elections.

  7. I am not law expert, but since BN has the majority, can they call for a vote of no confidence against Nizar? I don’t think they have the b… to face PR if the State Assembly is dissolved.

  8. Do we celebrate or shall we wait and see…one swallow does make a summer. At least, we are pleasantly surprised to find in our midst, a brave and decent judge …bravo!!
    Now the question is, will the shameless Z and his rowdy gang surrender their positions?
    Should they continue to stubornly clinch on to power, they will loose all respect of representatives of the people. It is about time, they start to behave like gentlemen and bring more disgrace to the nation.

    This is just a HIgh Court decision. They will appeal all the way up tpo Federal Court…

    That one (could) rule against Datuk Nizar.

    Then those UMNO … (could) say, why we cant accept Federal Court decision but they can accept High Court decision!!!

  12. This seems to be a fair judgement … I am not suprised by this as Tun M has said that Sultan has no right to sack MB. So quitely this might be the judgement that clear headed people in UMNO has hope for.

    This might explained why they even used police just to remove Siva from his seat. Next time they will reconvene the DUN and give NIzar a vote of No-Confidence!

    So the best thing for all is still back to dissolve the DUN. The more BN play it the more demage it will done to themselves.

    Still Victory for Nizar. He really stand out from this crisis.

This decision will go down in the annals of the Malaysian legal history simply because it upholds the genius that is our Constitution.The winner in this matter is ultimately the rakyat for this landmark judgment will surely pave the way to fresh elections.Our judiciary has come up trumps when least expected.

    This would now be BN’s next plot or strategy :

    1. To appeal against the decision of the High Court Judge to the Court of Appeal, Putrajaya.

    2. Zambry and geng may well loose his appeal at the Court of Appeal.

    3. Then Z and geng will appeal to the highest court of the land, the Federal Court and may just win the appeal…
