Court declares Nizar rightful MB

The real deal: Perak Mentri Besar Nizar Jamaluddin below the Democracy Tree

So the High Court has ruled that Nizar is the rightful MB and Zambry and his exco members are to vacate their posts with immediate effect.

Justice Abdul Aziz Abd Rahim ruled that a Mentri Besar can only be dismissed by a vote of no confidence.

This is a brave verdict by a courageous judge.

So where does this leave the Perak State Assembly, which now has “two Speakers”?

In my mind, as in the minds of most right-thinking Malaysians, the only way out of this mess is to dissolve the assembly.

Unless the BN wants to prolong the political mess by appealing the decision. But then, on 23 March, the Federal Court had already ruled that the case should be heard by the High Court.

God is great.  Does Zambry now hold the record for “Mentri Besar”  with the shortest reign? No, not even that, as he was never the Mentri Besar yang sah to begin with – as the High Court has just ruled and as most Malaysians already knew right from the start.

  • I wouldn’t go so far to say that the judge is courageous, he was merely doing his duty as seen fit.

    What is more interesting is that this is the only way out for BN and the Royal House of Perak. A side exit with the least bruises. Now its left to be seen if the Royal house will grant Nizar an audience for request to dissolve the DUN, since with the suspension of the three ADUNs led by the HeeHaw, its now a hung DUN. Valid reason to go back to the rakyat for a fresh mandate. Perakians must make very sure that this time Pakatan is firmly planted like the tree of democracy. And please tell Nga to keep his counsel.

    The PR’s assembly persons should file a court suit to declare the 7 May State Assembly sitting null and void as the then Speaker YB Sivakumar had not convened the sitting yet. Also, despite his physical presence in the Assembly, the BN’s friendly YB Hee Yit Foong, the then deputy Speaker, ‘usurped’ and assumed his role as Speaker illegally.

    Once the court rules that 7 May Assembly as null and void, then the Perak State Legislative Assembly automatically has to be dissolved for a fresh election!

  • Whatever happened to Karpal Singh’s case against the chief justice who was recorded saying that he used to bribe law clerks? When Zambry’s appeal goes to the federal court, there is only going to be one outcome… Even the judge Komathi who presided over Anwar’s sodomy case got her judgement overruled and then was put on leave… umno won’t give up Perak so easily… they know they will lose 59-0 if elections are held…

  • Let’s chase Zambry out of the official MB’s residence. Not forgetting the State Secretary. Now let’s show them who’s the boss!!

  • Just throw the question to Najib whether does he gain any lesson from this Perak Coup de tat?

    The whole nations had seen how the BN goons create the mess in the Perak State Legislative Assembly on 7/5/09!

    i. How Speaker Sivakumar had been ill treated!
    ii. How arrogant BN is to remove PR Speaker and restore BN Speaker without follow the procedures in Legislative Assembly!
    iii. How PDRM and certain unknown people manage to get into the Legislative Assembly Hall and move Speaker Sivakumar undignified!
    iv. Why the Speaker’s secretary who had been sacked previously allow to call for Assembly sitting without the knowledge of the Speaker!
    And there are many more!

    May be we can conclude the reason which come with today judegement is BN Najib are not dare to allow the court to set the dangerous PRECEDENT!

    Therefore, court rule MB Nizar win!

    Regardless of whatever the rulling on today, the image of BN is just beyond repair!

  • Well, the Najib and his party men cannot be trusted.

    Just read those people’s blog ,the rakyat will know that they are a bunch of … who practise the law of jungle. (RPK have published some in his recent posts)

    The police never use ISA to arrest them or charge them under Sedition Act.

    Can we trust the One Bolehland slogan? No way.They never walk the talk.

    To the courageous, righteous and conscientious judge, this is the day where the rakyat will remember you, you have done everyone proud and your good name will stay with your family and the history forever.

    You have at least rekindled a little hope among the Rakyat towards the judiciary. (Not APEK court definitely, their names have gone down to the longkang)).

    Ganeson is definitely not the lawful speaker, Sivakumar is.

    If the BN want to call for emergency assembly, well, Sivakumar will be the only one who can chair the assembly, not Ganeson.

    Of course, this time, they will use every tactic to block Siva from entering the building. This will also means more damage for Bee-End.

    Anyway, the best solution now is a fresh poll for the Silverians. This is the best timing for the HRH Sultan of Raja Muda to say YES to the Silverians- The Royal Family is always with you.

    BRAVO, The Judge, The People, The Ruler and the courageous Nizar and Team.

    I sincerely hope that this difficult ruling of yours will not endanger you or cause you hardship from certain “Pegawai” in the near future as you stand by our country’s Constitution and speak up for justice and truth.

  • Great judgement!! Lets nizar get the consent to dissolve state assembly. Lets perakian decide who they wanted to vote.
    Hope this time Pakatan can win with more majority.

  • The BN will convene a sitting to vote out Nizar and going by what happened on 7th, they may succeed. Let put who is the legit speaker aside.

    Once nizar is voted out in the assembly, he can seek an audience with the sultan to seek dissolution. Now here is the interesting part – how the sultan gonna act. we haave an opportunity can see whether the sultan is above politics or partisan.

    The sultan can withold his consent and reappoint zambry to be Mb again, but that would be a heavy price for the sultan to pay if he does it again.

    Then again, the sultan does not have much choice other than to acced to nizar’s request.

    Lets see how the sultan or raja muda plays his card.

  • Guys you forget one thing and I think Datuk Nizar has also forgotten it.

    he actually does not need the Perak’s consent to bubar the DUN anymore if the May 7th sitting is deemed illegal as Zambry the Illegal Alien is not the MB at the time and cannot advise the Sultan.

    Cause it would have passed the max time elapsed before the DUN must sit.

    Automtaically the DUN is dissolved and elections must be called.

    Why would Nizar need the sultan punya consent ?

  • A simple procedure that BN and UMNO chose to ignore. Using might to stampede the assembly was a shame to democracy. Stop this and please put the constitution on its highest alter. Without a respected constitution, the country will be ruined. Please, BN respect the constitution and the people will respect you. It does not take a genius to tell that the appointment of Zambry was illegal and the removal of Nizar was unconstitutional. Go by the laws and the people will respect you.

  • somehow it seems a better idea to armtwist fresh resignations from the 3 frogs than have expensive, exhausting statewide elections. that way, the 3 seat majority should revert to PR.

    based on current sentiment, state elections could mean a clean sweep for PR, leaving little BN opposition to provide the necessary check and balance against the PR state govt. and for the BN, a more face-saving move that will prevent them from being wiped out and hopefully, less vindictive.

    enough. we need a just, fast and clean resolution. now.

  • Why appeal in this case….it is a sure win for MB Nizar. For this case..fast fast appeal….but in the mongolian case where the prosecution (has a strong chance of winning)…dont want to appeal. What s… brain our govt possesed!!!!

  • Possible plan of action for tomorrow:

    1) Nizar and Ngeh Koo Ham with a core phalanx of supporters, lawyers and bodyguards go to the Palace at 8.30am to meet with the Regent of Perak to request the dissolution of the state assembly. Remind the Regent of the lies told by the three frogs before they jumped – that they were sick – and couldn’t be contacted by Pakatan Rakyat. Remind the Regent on the pending corruption and sex scandal cases against Osman and Jamaluddin. Remind the Regent on the status of Hee Yit Foong who no longer represents the voters of Jelapang…. Then leave it to the wisdom of Raja Nazrin Shah. Now is the time to WALK THE TALK.

    2) The rest of the Perak Pakatan Rakyat ADUNs backed by a small group of supporters, bodyguards and Unit Amal as well as Perak Pakatan Rakyat MPs to proceed to the State Assembly building and enter the state assembly as the the representatives of the rightful Menteri Besar, state government, state exco and Speaker of the House. The first thing is to order that the illegal BN ADUNs and illegal BN exco to vacate their office and empty it within 24 hours. Next they should issue directives to suspend the Sergent-at-Arms as well as the State Assembly Secretary. All this should be done at around or slightly after Nizar enters the Palace.

    3) Next Sivakumar should immediately affirm his decision to suspend Zambry and the BN exco for contempt of the state government and contempt of the Perak constitution. Another directive to be issued to suspend Hee Yit Foong for her role in illegally usurping the powers of the Speaker of the House. And another directive to bar the illegal Speaker and non-ADUN Ganesan from entering the state assembly.

    4) Early morning when the courts are opened tomorrow, Pakatan MPs and ADUNs from Selangor and KL should lead a delegation to file a suit against Hee Yit Foong for illegally usurping the powers of the Speaker and against Ganesan as the illegitimate Speaker of the House. Next they should file a police report against Zambry for impersonating the Menteri Besar and for enjoying the salary and perks as a MB illegally.

    5) Anwar Ibrahim to lead delegation with Zaid Ibrahim, Nik Aziz and Abdul Hadi Awang and persuade Pak Lah and Ku Li to request a meeting with the DYMM YDP Agong. The purpose of this meeting is to request the Agong to stop any moves from UMNO…

    And finally to all Pakatan supporters, do not demonstrate, do not utter seditious or offensive words against any race, religion or monarchy, do not be provoked… Just stay at home, go to work. Be cool.

  • It’s a trap.
    Why else was BN so insistent in appointing it’s own Speaker- to the point of using force.
    Furthermore, a Speaker who is not an Adun- thus no vote lost in the Assembly (unlike Sivakumar who could not vote).
    BN will now move a vote of no confidence and legitimise its rule of Perak.
    Remember, BN has been playing this game long before the rest.

  • There is no question who is the speaker because the one appointed by the HARAM MB is not legal binding… Even a kid can explain if something is haram appoint something else can the appointed be halal? But, this is Malaysia and we have BN as Federal Government so ‘semua boleh’ happen.

  • Next file a lawsuit to challenge who is the rightful speaker, BN like lawsuit but no election. We still can make them look like fool in court of law, whatever they try to do.

  • There I told you all already,
    how fast this BN goons got their appeal staying off the execution as decided by the high court. See, the fast and furious speed the appellate court judges decided. Normal case will take weeks or even month before being heard – another several months for the them to decide on your appeal.
    So, now you believe that the judiciary is better from before or otherwise. You all have been duped….. since time remembered.

    It is norm down here in Malaysia, the higher the echelons in the civil service they are more inclined towards BN political way. To align with BN is crucial…. for their after retirement goodies.
    (Many of) these senior civil servants are rotten cum corrupt to the core…from the day they joint the civil office.
    Dear all,pls make your own search, where are these people when they retired…. They led a more pampered and luxurious life after retirement.
    So… the need to listen to their master who fed them.
    Not surprising though!!! but expected.
